LAWYERS REJECT CLAIM OF CONFLICT
PARKER MCCAY BELIEVES IT HAS NO CONFLICT OF INTEREST
Below is an the email response received from Amy Guerin of Parker McCay with regard to the question the Reporter raised about their ability to fairly evaluate a any personnel complaint that may have been raised about Director Jason Carty.
The concern presented to Ms. Guerin was whether a possible conflict of interest exists since Carty hired Parker McCay for the Fire District and since he has a vote on the RVRHS Board of Education, which has also hired Parker McCay.
While not included in the email, readers should also note that in 2020, Parker McCay gave $2,600 to Carty’s wife for her political campaign.
Mr. Sondano,
My name is Amy Guerin and I am the Parker McCay attorney working directly with the Mount Holly Fire District. I have been forwarded your email below.
Although you do not ask a direct question, your email suggests that there is a conflict of interest with Parker McCay performing work for the Fire District because Jason Carty signed the Fire District’s engagement letter with Parker McCay while being an elected member of the Rancocas Valley Regional High School Board of Education, another Parker McCay client.
Please be advised that Parker McCay does not have any conflict that I am aware of.
With respect to the Fire District, Parker McCay’s client is the Board of Fire Commissioners. Mr. Carty is an employee of the Fire District and, at the Board’s direction, signed the engagement letter on the Board’s behalf. However, Parker McCay does not represent any individual Fire District employees, including Mr. Carty.
With respect to the Board of Education, Parker McCay represents the Board as a whole. It does not represent individual Board Members in their individual capacities.
In neither circumstance is Mr. Carty considered a client of Parker McCay. More importantly, there is no inherent conflict with Parker McCay representing both the Board of Fire Commissioners and the Board of Education.
I trust that this resolves any questions you may have had that were suggested by your email.
Sincerely, Amy R. Guerin, Esquire Counsel Labor & Employment/School Law
